Sayamaen, the operator of Magokoro Meicha Sayamaen (hereinafter referred to as “the Company”), hereby stipulates the following terms and conditions for the use of “Online Shopping within the Sayamaen Website” (hereinafter referred to as “the Service”) operated by the Company.
Article 1 (Scope of Application and Modification of these Terms and Conditions)

- Acts of using the Service through unauthorized use of a credit card.
- Unauthorized use of e-mail addresses and passwords.
- Actions that cause or may cause annoyance, disadvantage, or damage to other users, third parties, or the Company.
- Acts that infringe or may infringe the trademark, copyright, privacy or other rights of other users, third parties or the Company.
- Acts that are or may be offensive to public order and morals or violate laws and regulations.
- Any other actions that the Company deems inappropriate.
Violation of the prohibited acts is not only a mere breach of etiquette, but also a violation of the provisions of the Penal Code, Unauthorized Computer Access Prohibition Law, Trademark Law, Copyright Law, and Civil and Commercial Code, and is subject to criminal penalties and civil liability for damages.
Article 5 (Copyright)

We shall not disclose or provide to any third party any user information obtained by us in connection with the use of the Service, except in the following cases
- When the user agrees to disclose his/her name, address, gender, age, e-mail address, etc.

- When necessary for the provision of this service (e.g., when disclosing the name and address to a shipping company when shipping goods from the Company to the user).
- Other cases permitted under the Guidelines.
Article 7 (Purchase of Products)
- Users may use the Service to purchase products.
- When a user wishes to purchase a product, the user shall apply for the purchase of the product in accordance with the method designated by the Company.
- When we send an e-mail to the user confirming our acceptance of the application in the preceding paragraph, a sales contract for the product concerned is concluded between the user and us or the store that the user has designated to receive the product.
- However, even after sending the above E-Mail, Minebea may cancel the sales contract due to inventory conditions or other circumstances.
- Cancellation of the application under Paragraph 2 shall be as set forth in the User’s Guide and other documents separately provided by the Company.
Article 8 (Cancellation of Contract)
- The Company may terminate the contract for any of the following reasons
- If the user violates these Terms of Use
- When circumstances are discovered that may indicate that the user’s ability to pay is in jeopardy
- When an item is out of stock and cannot be easily delivered
- In the event that delivery cannot be made due to an undeliverable address or long-term absence
- Notwithstanding the provisions of the preceding paragraph, in the event of fraudulent or inappropriate use of the Service, the Company may cancel or terminate the purchase agreement, or take other appropriate measures.
Article 9 (Payment)
- The amount to be paid for the purchase of a product is the total of the purchase price of the product, shipping charges, handling charges and consumption tax.
- Some payment methods for products purchased through the Service may not be available depending on the contents of the product or the user’s age.
- In the case of payment by credit card, the user shall comply with the terms and conditions of a separate agreement with the credit card company. In the event of a dispute between the user and the credit card company, etc., the dispute shall be resolved by both parties concerned, and we shall have no responsibility whatsoever.
Article 10 (Return of Goods, etc.)

- If we are unable to contact you for 30 days after we have contacted you regarding the return of your package, you will be responsible for the full amount of your order. Please understand this in advance.

Article 11 (Management of Information)
- The Company may, at its discretion, delete comments and other information sent by users without notice to the users if any of the following items apply.
- When such information is deemed to clearly infringe upon the copyright or other rights of the Company or a third party, or to be defamatory or libelous to the Company or a third party
- If we receive a warning from a third party that such information infringes on the copyright or other rights of a third party or is defamatory or libelous to a third party

Article 13 (Other Disclaimers)
- In cases where the Company is obligated to notify a user, the Company shall be deemed to have fulfilled its obligation by sending a notification to the e-mail address registered in advance by the user, and in cases where the Company delivers a product, the Company shall be deemed to have fulfilled its obligation by delivering the product to the address indicated by the user when the product was purchased.
- In no event shall we be liable for any damages, losses, or disadvantages related to the use of this service or products purchased or sold through this service, regardless of the legal cause of action, other than as set forth in the preceding article.
- The Company shall not be liable for any and all damages incurred due to the user’s inability to use the Service.
- The Company shall be exempted from liability by processing the affairs in accordance with the user’s registration details.
- In no event shall we be liable for any damage, loss, or disadvantage arising from the use of this service, regardless of the legal cause of action.
- In the event that a user causes damage to another user or third party through the use of the Service, the user shall resolve the matter at the user’s own responsibility and expense, and shall not cause any inconvenience to the Company.
- When changing a user’s password, etc., the Company shall be exempted from liability by verifying the identity of the user in a manner designated by the Company.
Article 14 (Others)
- As a general rule, communication between the Company and the user shall be by e-mail and telephone.
- If any problem arises in connection with the use of the Service that cannot be resolved in accordance with these Terms of Use, the Company and the user shall discuss and resolve the problem in good faith between the Company and the user.
- If a lawsuit becomes necessary in connection with the use of the Service, the Kyoto District Court shall have jurisdiction as the court of first instance.
Article 15 (Overseas Delivery)
- Ownership and risk of the merchandise passes from the Company to the User once the merchandise ordered by the User has been shipped by the Company. Users must check the delivery status of the merchandise themselves.
No changes or cancellations will be accepted after the merchandise has been shipped, except in the case of defective merchandise or the wrong merchandise. - Delivery times may vary depending on the delivery service and customs conditions in each country, as well as natural disasters and accidents. We cannot guarantee delivery times.
- Depending on the destination country or region, customs duties, VAT (value-added tax), customs fees, etc. may be imposed by the government or local delivery company, and may be required separately upon receipt of the package.
- The Company will not provide any compensation, including returns, exchanges, or refunds, for damage or loss resulting from customs inspection.
- If you receive damaged or defective merchandise, please retain the merchandise and all of its packaging materials for investigation by the shipping company. You must also notify us within one week of receipt of such merchandise.
- In some countries or regions, depending on the shipping method selected by the user, the receiving location may be the local post office or customs office instead of the delivery address, but it is the responsibility of the recipient to pick up the package. If you do not hear from the post office or customs office when your package arrives, please contact the local post office or customs office with your package tracking number.
- In the event that a package is returned to us, the user will be responsible for all resending fees. The returned package will be resent by EMS (Express Mail Service), and the resending fee will be charged at the specified EMS rate.
- Please note that no refunds or changes will be made after 180 days from the date of order, even if refunds or returns are allowed under these Terms and Conditions.
